General Information

  1. The Terms and Conditions effective from January 1, 2013, define the rules for selling products offered by the store www.colorstories.pl, owned by ColorStories Agnieszka Czajkowska, located at ul. ANTONIEGO KOCJANA 1/8 01-473 Warsaw, registered in the business register issued by the Mayor of the Capital City of Warsaw under the numbers: NIP 5222539972, REGON 146242483.
  2. Sales are conducted via the Internet in the form of a distance contract between the ordering adult natural person or company, hereinafter referred to as the Client, and the online store colorstories.pl, hereinafter referred to as the Store. The recording, securing, and provision of the essential provisions of the concluded contract take place by printing and providing the client with a receipt or VAT invoice along with the shipment.
  3. All products available in the store are brand new and free from defects.
  4. The prices listed in the store include VAT and are gross retail prices expressed in Polish zlotys.
  5. Photos and images of products presented in the Store may slightly differ from their actual appearance.

Privacy Policy

  1. By placing an order, the Client consciously agrees to the processing and use of their personal data for the purpose of fulfilling the order.
  2. Personal data entered into the store’s database is processed exclusively for its needs and is not and will not be shared with other entities. This data is collected with due diligence and appropriately protected against access by third parties, in accordance with the Act of August 29, 1997, on the Protection of Personal Data (Journal of Laws of 1997, No. 133, item 883). The Client has the right to access their data, to correct it, and to demand cessation of its use. The data can be viewed and modified after logging into the Store.
  3. The content of the Colorstories.pl does not constitute a commercial offer within the meaning of Article 543 of the Civil Code.
  4. The Client is the only person authorized to perform operations on their account. The Store is not responsible for the actions of persons to whom the Client has granted access to the Account.
  5. The Client is obliged to promptly notify the Store of any case of violation of their rights, as well as any case of violation of the rules specified in these Terms and Conditions.
  6. The User who has completed Registration may terminate the electronic services contract by deleting the Account, which involves submitting a request for Account deletion. The Portal Administrator is obliged to delete the account within 5 days from the date of receiving the aforementioned request.
  7. The Client is obliged to provide true data during the Registration process.
  8. The Client has the right to submit a complaint related to the functioning of the Portal within one month from the date the irregularity occurred. Complaints submitted after this period will not be considered. The date of submission of the complaint is considered to be the day it is received by ColorStories Agnieszka Czajkowska. The complaint should include the first name, last name, correspondence address, the date, and the type of irregularity that occurred. Complaints will be processed within 30 days from the date of receipt, and the Client will be informed of the decision immediately. Complaints should be sent by registered mail to the address: ColorStories Agnieszka Czajkowska ul. ANTONIEGO KOCJANA 1/8 01-473 Warsaw with the note “Reklamacja Colorstories.pl” or sent by email to: kontakt@colorstories.pl with the subject “Reklamacja ColorStories.pl”.

Rights and obligations of the store

  1. Colorstories.pl store allows the Client to place orders through the portal. The Store has the right to refuse Client registration or accept an Order, as well as delete the Client’s Account or cancel the order, especially if the Client: provided false data, violated the personal rights of third parties, especially the personal rights of other Users, engaged in behavior that is inconsistent with the Terms and Conditions or applicable law.
  2. The Store is not responsible for technical problems or technical limitations occurring in the computer equipment, end device, IT system, and telecommunications infrastructure used by the Client, which prevent them from properly using the Store.
  3. The store reserves the right to suspend or terminate the portal’s operation, change the prices of goods listed in the offer, introduce new products to the online store offer, conduct promotional campaigns on the portal pages or make changes to them.
  4. The Store has the right to use “Cookies” and “web beacons” to ensure the proper functioning of the portal, analyze the portal’s effectiveness, adapt it to users’ needs, and create statistics.
  5. The entire website (mechanisms and graphics, photos, and descriptions) are the property of the store. According to Dz. U. 94 Nr 24 poz. 83, corrected by Dz. U. 94 Nr 43 poz. 170, copying, processing, and distributing these materials in whole or in part without its consent is prohibited and constitutes a violation of copyright.

Placing and confirming an order

  1. Purchases can be made by a person registered in the store or an unregistered person who, on a one-time basis, provides the necessary delivery address data (first name and last name, street, postal code, city) and contact details (first name and last name, phone, email) in the order form. Registration shortens and simplifies the formalities related to purchases.
  2. In the case of providing false, incomplete, or incorrect data – the Store will try to contact the Client to complete or correct it. If contact is not possible, the Store may withdraw from the sales contract.
  3. Acceptance of the order for execution is confirmed by an email sent by the Store to the Client. In case of any discrepancies in the content of the order acceptance confirmation, contact the store at kontakt@colorstories.pl. Additionally, a Store employee may contact the Client by phone to confirm the order.
  4. Shipment preparation takes place after: a) in the case of cash on delivery orders – email confirmation of the order placed by the Client in response to the Store’s email. If the Store cannot contact the Buyer or does not receive email confirmation of purchase within 5 days – the transaction will be canceled; b) in the case of orders paid via PayU, PayNow, PayPal – after the funds have been credited to the Store’s bank account.
  5. The payment term is 5 days. If payment is not made within this time, the order will be canceled.
  6. The order will be fulfilled provided that the goods are available in stock. In the case of ordering an unavailable product, the store will contact the Client, who will decide on the manner of order fulfillment (partial fulfillment, extension of the waiting time, cancellation of the entire order). If a product the Client wishes to add to the order is not in stock, they have the option to receive information about its availability by providing their email address and adding the product to the wishlist. The store sends a message to the Client’s provided email address informing what goods and when they are available.
  7. A limited number of goods is allocated for promotional sales and clearance sales, and orders are fulfilled according to the order of receipt of confirmed orders for these goods until stocks are depleted.
  8. For each order, at the moment when all goods ordered by the client are collected and ready for shipment, a receipt or VAT invoice is issued. Placing an order is equivalent to authorizing the online store to issue an invoice without the need to obtain the Client’s signature.
  9. The Client may make changes to the order or withdraw it until the shipment. Making changes or withdrawal is possible by contacting the store at zamowienia@colorstories.pl.
  10. The order processing time, from the moment the money is credited to the company’s account, is a maximum of 5 working days, unless the information by the product states otherwise or the Client is informed about the extended processing time by email or phone. The order processing time is counted from the moment of obtaining positive payment authorization.
  11. The delivery time should be added to the order processing time.

Prices and payment methods

  1. All prices are given in Polish zlotys and include VAT. The price listed with each product is binding at the moment the customer places the order.
  2. The prices of goods do not include the cost of the shipping service. The cost of transport is covered by the Client.

  4. International delivery is possible. Shipping costs will be provided in the cart after selecting the location. The cost of transport, taking into account the combined effect of price, speed, and delivery reliability, is calculated individually.

Delivery

  1. The Client can choose one of the following delivery methods for the ordered goods: Courier – prepayment, Courier – cash on delivery, Parcel locker. The shipment is confirmed by email.
  2. The average order processing time is 2-3 working days, and a maximum of 5 working days, unless the information by the product states otherwise. This is the time that elapses from placing the order to shipping the ordered goods from the store. In exceptional cases and individual orders, this time may be extended, about which the client will be informed individually.
  3. The receipt date = the order processing time + the estimated delivery time.
  4. Colorstories.pl makes every effort to ensure that the shipment arrives in the shortest possible time.
  5. Shipping of purchased goods is possible via courier company. The standard delivery time is 1-3 working days.
  6. In case of orders sent via courier, the Client is obliged to contact the Store if the package is not delivered within 2 working days from the date of dispatch. A Client who fails to do so will be charged with the shipping costs if the undelivered package is returned to the Store.
  7. In case of unjustified refusal to accept an ordered and undamaged shipment by the Client, the ordered goods return to the Store, and the Client will be charged with the shipping costs and a handling fee amounting to 25% of the value of the purchased goods.
  8. When receiving the package, special attention should be paid to the condition of the package, whether it is mechanically damaged, or if the adhesive tape on the shipment has been broken. If there are damages that may cause destruction of the contents, the package should be opened in the presence of the courier.
  9. The promotion for free delivery from 299 zł applies only to prepaid orders sent within Poland by DPD courier.

Returns/complaints

  1. The client has the right to withdraw from the purchase made in our store without giving a reason within 14 days from the date of receipt of the shipment.
  2. Returns without questions asked apply only to goods without visible signs of use, clean, complete, odorless, with intact tags and labels. Returned goods should be sent along with the receipt or invoice received with them and information about the account number to which the refunded money should be transferred. The cost of returning goods is non-refundable. In the case of an order with free shipping, the client bears the cost of returning the package.
  3. Items should be returned to the address: 4Values Hala nr 3, Dorota Bednarz, ul. Parzniewska 4, 05-800 Pruszków. The return must be sent within 14 days of informing the Store about the intention to return. If the deadline is exceeded, the package will not be accepted. Returns can also be made via the https://wygodnezwroty.pl/colorstories website.
  4. To exercise the right of withdrawal from the contract, the Client submits a clear statement of withdrawal in one of the following ways: sending an email to the address: kontakt@colorstories.pl or by filling out and submitting the online form https://colorstories.pl/formularz-zwrotow-reklamacji/.
  5. To meet the deadline for withdrawal from the sales contract, it is sufficient for the Client to send the information about exercising the right of withdrawal before the expiration of the 30-day deadline referred to in point 1 above.
  6. Refunds are made by bank transfer to the account indicated by the Client in the statement of withdrawal from the sales contract or to the bank account from which the Client made payment by online bank transfer, no later than 14 days from the moment of receiving the returned products and the Client’s statement of withdrawal from the sales contract. The refund is carried out depending on the payment method chosen by the Client.
    • In the case of payment by quick online transfer (e.g., PayU, PayNow), the refund is made using the same payment method.
    • In the case of payment by payment card – the refund goes to the same card.
    • In the case of payment via system PayPal – the refund goes to the PayPal account of the Client.
    • In the case of payment by cash on delivery – the refund is made by transfer to the bank account indicated by the Client in the return form.
  7. All goods available in the store are covered by the manufacturer’s warranty.
  8. If after receiving the goods the client finds technical defects or damages caused during delivery, they can file a complaint about the defective goods based on the warranty regulated by the Civil Code or the guarantee if provided. The seller is liable to the client for the sold goods if a defect is detected within 2 years from the moment of delivery. For the first year of seller liability, it is presumed that the defect or its cause existed at the time of sale. If a defect is noticed later, between 12 and 24 months from the delivery, the client must prove that the defect existed at the time of purchase. Using the warranty, the client can, according to the rules and deadlines specified in the Civil Code:
    a) Submit a statement on price reduction
    b) In case of a significant defect – submit a statement on contract withdrawal
    c) Demand replacement of the item with a defect-free one
    d) Demand defect removal
    The seller requests to submit complaints based on the warranty to the address kontakt@colorstories.pl. If it turns out that to consider the complaint it is necessary to deliver the claimed goods to the seller, the client is obliged to deliver the goods by courier shipment to the address: 4Values Hala nr 3, Dorota Bednarz, ul. Parzniewska 4, 05-800 Pruszków. Please also notify the store of your intention to return the goods by email to kontakt@colorstories.pl. The store refunds the costs related to returning the claimed goods immediately after receiving the shipment and considering the complaint. The store refunds the delivery costs of the claimed goods corresponding to the cheapest shipping option available in the store’s offer. The returned goods should include the invoice or receipt and a note explaining the reason for the complaint. All complaints are considered no later than within 14 working days from their receipt. Damaged goods will be replaced with another, fully valuable one, and if this is not possible (e.g., due to stock exhaustion), the store will refund the buyer the equivalent of the product price or offer other available products from the store to choose from.
  9. Complaints do not apply to: natural wear and tear of the goods, mechanical damages (tearing) resulting from the use of the goods, damages caused by improper fitting or improper use and washing/maintenance, as well as obvious defects visible at the time of receiving the package that were not reported immediately upon their detection.
  10. Complaints regarding differences in the appearance of ordered goods compared to received ones, resulting from improperly set parameters of the Client’s monitor, do not constitute grounds for returning the goods.
  11. If the delivered product matches your order, but you would like to exchange it for another, please report this fact by email or phone.
  12. The store does not accept cash on delivery shipments and does not offer free returns via https://szybkiezwroty.pl/.

Data Protection

  1. By placing an order, the Client knowingly provides personal data for the purpose of order fulfillment.
  2. The personal data stored in the store’s database are processed solely for its needs, are not and will not be shared with other entities. These data are collected with due diligence and properly protected in accordance with the Store’s Privacy Policy and the applicable Regulation on the Protection of Personal Data – GDPR.
  3. The content of the Colorstories.pl does not constitute a commercial offer within the meaning of Article 543 of the Civil Code.
  4. The Client is the only person authorized to perform operations on their account. The Store is not responsible for the actions of persons to whom the Client has granted access to the Account.

Final provisions

By placing an order, the buyer accepts the above terms and conditions.

The service provider reserves the right to change these Terms and Conditions at any time. Changes shall take effect upon their posting on the Portal’s website. For registered Clients, the new provisions of the Terms and Conditions shall apply unless they terminate the electronic service contract within 30 days from the date of notification of the change in the Terms and Conditions, which will be sent electronically to the address provided by the Client during registration.

The current Terms and Conditions are published on the Store’s website and provided free of charge to the Client (electronically) upon their request.

In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other laws shall apply.
