TERMS AND CONDITIONS OF THE COLORSTORIES.PL ONLINE STORE

Version effective from: 01/01/2026

1. General provisions

1. The online store available at colorstories.pl (hereinafter: the “Store”) is operated by:

   ColorStories Agnieszka Czajkowska, ul. Antoniego Kocjana 1/8, 01-473 Warsaw, entered in the register of business activity maintained by the Mayor of the Capital City of Warsaw, VAT ID (NIP): 5222539972, REGON: 146242483 (hereinafter: the “Seller”).

3. These Terms and Conditions set out the rules for:

   • using the Store, including services provided by electronic means,

   • placing orders and concluding distance sales contracts,

   • payments and delivery,

   • withdrawal from the contract (returns),

   • complaints (Seller’s liability for lack of conformity of goods with the contract) for contracts concluded from 01/01/2023.

4. The Store sells exclusively to Consumers.

5. The Store delivers within Poland and to European Union countries.

6. Information presented in the Store constitutes an invitation to conclude a contract within the meaning of the Polish Civil Code.

2. Definitions

1. Consumer – a natural person making a purchase not directly related to their business or professional activity.

2. Goods – a movable item offered in the Store.

3. Agreement – a distance sales contract for the Goods concluded between the Consumer and the Seller via the Store.

4. Order – the Consumer’s declaration of intent directly aimed at concluding the Agreement.

5. Business day – a day from Monday to Friday, excluding public holidays.

6. Durable medium – material or a tool enabling information to be stored in a way that allows access to it in the future (e.g., e-mail).

3. Technical requirements

To use the Store, you need:

• a device with Internet access,

• an up-to-date web browser,

• an active e-mail address.

4. Services provided by electronic means

1. The Seller provides, free of charge, electronic services related to the operation of the Store, in particular:

   • customer account management (if created),

   • shopping cart,

   • contact form,

   • newsletter (subscription/withdrawal of consent),

   • availability notifications,

   • publication of reviews (Trusted Shops).

2. The Consumer may resign from the services at any time and free of charge, in particular:

   • delete the account – by contacting the Seller by e-mail,

   • unsubscribe from the newsletter – via the link in the message or by contacting the Seller by e-mail.

3. Complaints regarding electronic services: The Consumer may submit a complaint by e-mail to [email protected], describing the issue. The Seller will respond within 14 days of receiving the complaint.

5. Reviews in the Store

1. The Store may enable publishing opinions and reviews using the Trusted Shops tool.

2. Reviews published in the Store may be published automatically – the Seller does not verify each time whether a review comes from a person who purchased the Goods.

3. The Seller reserves the right to remove unlawful content or content that violates good customs.

6. Placing orders and concluding the contract

1. Orders may be placed 24/7 via the Store.

2. An Order is placed by:

   • selecting the Goods and adding them to the cart,

   • providing the data required to process the Order,

   • selecting the delivery and payment method,

   • confirming the Order with the button finalizing the purchase.

3. The Agreement is concluded when the Seller confirms acceptance of the Order for processing (an e-mail message to the address provided).

4. The Seller may contact the Consumer to clarify doubts (e.g., incorrect address details).

5. The Seller processes Orders for Goods available in stock. If a product is unavailable, the Seller will contact the Consumer to determine further steps (e.g., extended processing time, partial fulfillment, cancellation).

7. Prices, promotions and discount rules

1. Prices of Goods in the Store are gross prices (including VAT) and do not include delivery costs.

2. The final value of the Order (Goods + delivery) is provided before placing the Order.

3. In the case of price reductions, the Store provides information on the lowest price from the 30 days prior to the reduction (in accordance with applicable regulations).

4. The Store may provide discount codes. If discounts cannot be combined, the cart will apply the discount more favorable to the Consumer.

8. Payments and invoices

1. Available payment methods are presented in the cart.

2. The Store enables, among others, online payments via operators (e.g., PayNow, PayPal, or Przelewy24) as well as methods such as BLIK, payment cards, traditional bank transfer, Apple Pay, Google Pay, PayPo – depending on the options available when placing the Order.

3. Cash on delivery is also possible – if the option is available in the cart.

4. Blue Media S.A. is the entity providing online payment services for card payments.

5. The Seller issues invoices and provides them to the Consumer in electronic form (e-mail) or in another way available in the Store.

9. Delivery

1. Delivery is carried out within Poland and to EU countries. International shipping is provided by DPD.

2. Available delivery methods in Poland (e.g., courier, parcel lockers) depend on the options available in the cart at the time the Order is placed.

3. Delivery costs (PL/EU) and the estimated delivery time are presented in the cart before placing the Order.

4. The Store may offer free delivery (e.g., from a specified amount). The conditions of the promotion are provided in the cart and/or in promotional communications.

9.1. Special situations: non-delivery / return of an uncollected parcel / damage

1. Parcel not delivered / lost – after confirming the problem, the Seller refunds the funds.

2. Parcel returned as uncollected – if the shipment is not collected by the Consumer and is returned to the Seller (e.g., after the collection deadline at a point/parcel locker) without prior contact with the Seller, the Seller may cancel the Order and refund the payment only for the price of the Goods, i.e., excluding the cost of delivery to the Consumer.

   At the Consumer’s request, the Seller may ship the parcel again – after the Consumer pays the cost of reshipping according to the rates available in the Store on the day of reshipment.

3. Damaged parcel – the Seller accepts the report and contacts the carrier to file a transport complaint.

   The Seller recommends keeping the packaging, taking photos, and reporting the problem immediately after receipt.

10. Right of withdrawal (returns)

1. The Consumer has the statutory right to withdraw from the Agreement within 14 days. The Seller grants the Consumer an extended withdrawal period – 30 days from the date of receiving the Goods.

2. To exercise the right of withdrawal, the Consumer submits a statement:

   • by e-mail to [email protected], or

   • in another way made available on the returns page: https://colorstories.pl/zwroty/

3. To meet the deadline, it is sufficient to send the statement before the expiry of 30 days.

4. The Consumer must return the Goods without undue delay, no later than within 14 days from the date of submitting the withdrawal statement.

5. The Store does not accept return shipments sent cash on delivery.

6. The Consumer is liable for any diminished value of the Goods resulting from using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

10.1. Return address

Returns should be sent to:

10.2. Return costs and Wygodne Zwroty

1. The Consumer bears the direct costs of returning the Goods.

2. The Store provides the option to return via Wygodne Zwroty: https://wygodnezwroty.pl/colorstories.

3. The return cost is payable by the Consumer and is visible in the application/service (according to the operator’s price list).

10.3. Refund of payments

1. The Seller refunds the Consumer’s payments without undue delay, no later than within 14 days from the day the Seller receives the returned Goods or proof of their return (whichever occurs first).

2. The refund will generally be made using the same payment method that the Consumer used (unless the Consumer agrees to another solution).

3. In the event of withdrawal from the Agreement in full, the Seller also refunds the cost of delivery to the Consumer – up to the amount of the cheapest ordinary delivery option available in the Store.

4. In the event of withdrawal concerning part of the Order, the delivery cost to the Consumer is not refundable.

5. In the case of cash on delivery, the refund is made by bank transfer to the account indicated by the Consumer.

6. The Store does not offer exchanges under withdrawal – please return the Goods and place a new order.

11. Complaints – lack of conformity of goods with the contract (for agreements from 01/01/2023)

1. The Seller is liable for lack of conformity of the Goods with the Agreement existing at the time of delivery and revealed within 2 years from the date of delivery.

2. A complaint may be submitted:

   • by e-mail to [email protected], or

   • according to the instructions on the complaints page: https://colorstories.pl/reklamacje/

3. The complaint should include at least: the Order number, a description of the issue (lack of conformity), and contact details.

4. The Consumer may, in the first instance, request repair or replacement of the Goods. The Seller may propose an alternative solution if the chosen method is impossible or would require excessive costs.

5. The Consumer may request a price reduction or withdraw from the Agreement if the statutory conditions are met (including when the Seller does not bring the Goods into conformity within a reasonable time or when the lack of conformity is significant).

6. The Seller will respond to the complaint on a durable medium within 14 days of receiving it. Failure to respond within this period means the complaint is deemed accepted.

7. The Seller bears the costs related to the complaint (including return shipping, repair or replacement).

8. During the complaint process, the Seller provides the Consumer with a convenient way to return the Goods – in particular by generating a shipment code for an InPost parcel locker or another equivalent solution.

12. Vouchers, gift cards and value codes

  1. The Seller may offer vouchers, gift cards or value codes that entitle the Consumer to reduce the value of an order by a specified amount, in accordance with the terms indicated for a given voucher, gift card or code.
  2. A voucher, gift card or value code may be used once only, exclusively when placing one order in the Store, unless the terms of a given voucher, gift card or code expressly provide otherwise.
  3. If the value of the order is lower than the value of the voucher, gift card or value code, the unused part of the value does not carry over to another order, is not recorded as the Customer’s balance and cannot be used at a later date.
  4. The unused part of the value of a voucher, gift card or value code is not paid out in cash and is not refunded to a bank account, unless mandatory provisions of law provide otherwise.
  5. If the value of the order exceeds the value of the voucher, gift card or value code, the Consumer pays the difference using one of the payment methods available in the Store.
  6. A voucher, gift card or value code cannot be combined with other discount codes, promotions or price reductions, unless the terms of a given promotion expressly provide otherwise.
  7. The validity period of a voucher, gift card or value code is indicated when it is issued or sent to the Consumer. After the expiry date, the voucher, gift card or code may no longer be available for use.

13. Personal data and cookies

1. The Seller is the controller of personal data.

2. Detailed rules for processing personal data and cookies are set out in the Privacy Policy available at: https://colorstories.pl/privacy-policy/

14. Out-of-court dispute resolution

The Consumer may use out-of-court dispute resolution methods, in particular via the municipal/county consumer ombudsman or the Provincial Inspectorates of the Trade Inspection.

15. Final provisions

1. These Terms and Conditions are made available free of charge on the Store’s website in a manner enabling them to be obtained, reproduced and stored.

2. The Seller may amend these Terms and Conditions for important reasons (e.g., changes in law, payments, delivery, functionalities). The amendments do not affect Orders placed before the amendments enter into force.

3. Matters not regulated in these Terms and Conditions are governed by Polish law, in particular the Polish Consumer Rights Act.
